Agenda Title:

Approve Request from Dana Foreman for A&A Engraving, Inc. for a Variance to Waive the Requirement to Install Sidewalk per City Ordinance 12.08.060 along Sedivy Lane and East St. Andrew Street adjacent to 2302 East St. Andrew Street, Rapid City.

Summary:

A request was received in the Engineering Office on 11/3/15 requesting the requirement to install sidewalk along Sedivy Ln and E. St. Andrew St. per City of Rapid City Ordinance 12.08.060 be waived. A 5’ sidewalk is required to be constructed along these streets at the time of building permit, with the property having approximately 500’ of street frontage. The requested variance will allow for an expansion of an existing industrial building without the installation of sidewalk in the adjacent right-of-ways.

Adjacent Sedivy Ln and E. St. Andrew St. are industrial roads with Sedivy Ln having 28’ of pavement with curb and gutter, and E. St. Andrew St. having 26’ of gravel. No sidewalk is located on either street, with the nearest sidewalks located at the East St. Patrick St. and Sedivy Ln intersection, approximately 500’ away. All of the surrounding properties are constructed on today and sidewalk on adjacent properties does not seem foreseeable in the conceivable future.   

The Rapid City Council has the authority to order in sidewalk at any time, should sidewalk in this area become necessary.
